By accessing or using JC3 software products ("Software") or the JCAN LLC website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software or Site.
JC3 software is provided under a tiered licensing model:
Licenses are non-transferable and bound to specific devices via cryptographic device binding. License keys are signed with Ed25519 and verified locally by the daemon.
JC3 software is designed for lawful use by:
You agree not to use the Software for any unlawful purpose, to circumvent license restrictions, to reverse engineer the encryption implementation (except where permitted by applicable law), or to distribute the Software to prohibited parties.
EXPORT NOTICE: JC3 software contains strong cryptographic technology and may be subject to U.S. export controls under the Export Administration Regulations (EAR) and/or the International Traffic in Arms Regulations (ITAR). Export, re-export, or transfer of this software to prohibited countries, entities, or end-uses is strictly prohibited. Users are responsible for compliance with all applicable export control laws and regulations.
The Software may not be exported or re-exported to any country subject to U.S. sanctions, or to any person or entity on the U.S. Treasury Department's Specially Designated Nationals list or the U.S. Commerce Department's Entity List.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. JCAN LLC DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.
IN NO EVENT SHALL JCAN LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. JCAN LLC'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.
While JC3 implements strong encryption (AES-256-GCM, ChaCha20-Poly1305) and follows security best practices (FIPS 140-2/3, NIST 800-53, DISA STIGs), no software can guarantee absolute security. JCAN LLC does not warrant that the Software is impervious to all attack vectors. Users deploying JC3 in classified environments are responsible for obtaining appropriate Authority to Operate (ATO) from their accreditation authority.
JC3, JCAN, and all associated trademarks, logos, and trade names are the property of JCAN LLC. The Software and all associated documentation are protected by copyright. Your license does not grant you any ownership interest in the Software.
JCAN LLC may terminate your license if you breach these Terms. Upon termination, you must cease all use of the Software and destroy all copies. The Community tier may be used indefinitely subject to these Terms. Paid licenses are valid for their purchased duration.
These Terms shall be governed by and construed in accordance with the laws of the United States of America and the state in which JCAN LLC is incorporated, without regard to conflict of law principles.
JCAN LLC reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Software after changes constitutes acceptance of the modified Terms.
